Terry Green was compensated $5,000 in a settlement with the City of Bandera last week after a faulty city water curb stop caused water damage to house.
“Last winter Mr. Green called to have the water turned off at the meter, then we had that storm and the lines froze, but the water was still open,” City Administrator Mike Cardenas told council during their Nov. 17 regular meeting. “Our cutoff was turned completely off, but it was still allowing water to pass through, and it damaged his house.”
The insurance arm of the Texas Municipal League denied the city’s claim on behalf of Mr. Green, stating that because the damage occurred through no intention of the city. TML contended that the city is immune to the claim because city workers did all they could to turn off the water line.
“But if the curb stop held, he wouldn’t have had this problem,” Cardenas said.
Green said he appreciated the treatment he had received from the city, explaining he did not feel his claim was egregious.
“The house was vacant and we went by to change some lights when we heard dripping,” Green said. “That’s when we saw the master bedroom ceiling had collapsed.”
Green said the damage estimate was just under $10,000, with his insurance through Germania covering half the bill, hence his request the city settle the remainder to finish repairs to the ceiling, walls and floors.
“I’m not trying to recover my time, and I’m not looking for sympathy. I feel this is a good compromise,” Green said.
City Attorney Barbara Boulware-Wells said there was no legal reason the city could not settle with Green if council felt the responsibility for the damage lay partially with the city. She said the city should request a release of all future claims, which Green agreed to without hesitation.
City Treasurer Ernie DeWinne said the only location the settlement funds could come from in the budget would be the city’s reserve infrastructure fund.
