Rosenberg-based roofer agrees to pay restitution, better inform customers

— Holden Roofing Inc., whose crews worked throughout the Coastal Bend after hail storms earlier this year, agreed Friday to pay restitution to some homeowners they solicited.

The Rosenberg-based company agreed to reimburse homeowners who paid the company's liquidated damages contracts after Jan. 1, 2009, according to Texas Attorney General Greg Abbott's office.

The company and its President Brett Holden were named as defendants in the state's lawsuit filed June 23 .

"We tried to cooperate with the attorney general," said Scott McLemore, attorney for Holden. "They didn't like our paperwork and we agreed to comply with some changes they requested, and both parties agreed there was no admission of fault. We thought cooperating with them would be a benefit."

The suit followed an investigation of complaints about the company profiled in two Caller-Times Troubleshooter columns in May. They informed the public of Holden's Consultation and Assistance Agreement that obliged people to pay 20 percent of estimates if they used a different company for roofing repairs.

The columns described the experience for Corpus Christi retirees Bruce and Lois Cox, who were threatened with legal action by Holden Roofing after they signed the agreement then hired another firm to replace the roof of their Calallen area home.

Court documents the attorney general's office filed June 23 in San Patricio County District Court alleged the company unlawfully coerced homeowners, such as the Cox couple, into using their services for roof repairs or they were subject to unlawful penalties.

"Some of my customers were so fretful," said Aubrey Bryan, the Coxes' insurance agent. "Some customers who used Holden for the work were happy, but those who used somebody else and got charged were upset."

Ten customers are eligible for repayment of the fees they paid, and five other customers will receive $500 each, according to the agreed judgment Friday. The company also must pay $25,000 in civil penalties and $10,000 for attorneys' fees for the state's enforcement action.
