Florida Office of Insurance Regulation statistics reveal that there are fewer drivers, fewer collisions and fewer crash-related injuries in Florida. Yet PIP claims in Florida increased by 37.5 percent from 2008 to 2010.
The numbers don't add up, and they are not sustainable. State officials warn that allowing this fraud to continue may result in an automobile-insurance availability crisis in our state. This is of great concern to my organization, Associated Industries of Florida, because it will place an undue burden on businesses, especially businesses that rely upon vehicles for their operations.
Gear Up Florida, a coalition of consumers, business associations and law enforcement agencies, is recommending to the Legislature four commonsense fixes:
Allow insurance companies adequate time to investigate suspicious claims.
Cap lawyer fees in no-fault cases to eliminate the incentive for frivolous litigation.
Require greater accountability from Florida medical providers that treat PIP claimants.
Prevent alternative medical operations from providing unnecessary and excessive treatment.
PIP fraud has become an organized crime — one that costs Floridians nearly $1 billion per year in increased premiums.
Here's how automobile accident fraud works: Networks of motorists, clinics that provide treatment to PIP claimants and dishonest personal-injury attorneys have banded together in organized rings to abuse the system and Florida's insured drivers. According to the Florida Sheriffs Association, undercover investigations reveal that many participants in staged accidents are parts of larger groups. A staged crash is just the first step in a chain of events planned to defraud insurance companies.
Paid crash participants are coached on what to say to the doctor, enabling the doctor to file a claim against the motorist's PIP insurance. Once at the clinic, participants typically sign blank treatment forms in advance or will go to the clinic for "treatment" until the clinic reaches the $10,000 PIP limit. These clinics each commonly have incomes of more than $1 million per year.
